Ex-president constitutional Court Ernesto Blume dismissed recent statements by Americo Guevara, president of the Association of National Universities of Peru (AUNAP), who denounced the intention to deprive the National Authority for Higher University Education (Sunedu) of autonomy by violating the constitution.
“It is not true that this organization called AUNAP has the most universities, it has five or six universities and then it has a group of pseudo-universities that have not finished their regularization and recognition, therefore there are four or five people. who will take this name and raise the flag,” he said.
In an interview with RPP News, Ernest Bloomwho advises supporters of Law No. 31520, approved constitutional Courtpointed out that this ordinance directs that new members of Sunedu be appointed within 30 days to take over the position and that previous members be dismissed.
Despite this, the lawyer called it “unusual” that ten months after the rule was published, new members of Sunedu had not yet been elected, despite the fact that Constitution indicates that this law is implemented from the day after its publication. In addition, he pointed out that it is incorrect, as Guevara points out, to say that the process will be illegal because the law has been suspended.
“That’s not true because the judge ordered Congress to suspend the application of the law, but he ordered Congress to give an impossible mandate because Congress passes the law, publishes it, takes effect, and Congress is not a judge. “The order was to suspend the law, but Congress cannot do that,” he said.
“The haste is to prevent us from continuing to put on this painful spectacle for a country in which a public institution that must comply with the law, we are witnessing a shameful act that cannot happen in a constitutional state that the law that has been in force since July 2022 year, is not fulfilled despite having all the time in the world,” he added on another occasion.
“We decided not to return to ANR”
Previously Rector Agricultural University of La Molina, Américo Guevara Pérez cited the university counter-reform law that came into effect after the Constitutional Court ruled unfounded an unconstitutionality lawsuit filed by Congress itself. With this in mind, also the President of the Association of National Universities of Peru (Aunap) noted that They are committed to university quality and they have no intention of returning to a system like that of the former National Assembly of Rectors (ANR).
“We chose university quality, for not returning again to the old National Assembly of Rectorswe have made a bet that the few resources that are invested in education are very well directed, and that we are preparing good professionals, professionals who go to serve the country and integrate into society as a whole with appropriate values, and this is what we proclaimed and continue to do this with Aunap,” he said in News extension from PTR.
On the other side, Guevara Pérez believed that the selection process for a new superintendent, Sunedu, would be irregular.because the call was made at a time when the law was suspended by the judiciary. This is due to the amparo lawsuit filed by Sunedu herself.
“It is true that Law 31520 is passed by Congress and signed into law by the executive branch. However, the judge accepts the amparo’s claim and the whole process is suspended until the Constitutional Court decides that the law is valid. out, not before. The rector of the oldest university was called at a time when this law was suspendedTherefore, this choice is not valid for us (…). A university committed to the country, a university committed to development, is not afraid of supervision,” he said.
