The executive power adopted today, on Sunday, a resolution on the introduction of a state of emergency in the regions. Virgin, Cusco, Puno, Apurimac, Arequipa, Moquegua And tacnain connection with the socio-political crisis experienced since December 7 last year in the country.
This measure was officially published in an extraordinary issue of the Official Gazette of El Peruano and signed by the President of the Republic. Dina Boluarte; prime minister Alberto Otarola; defense minister, Jorge Luis Chavez Cross; and Minister of Justice Jose Tello.
Measuring ranges
According to the Supreme Decree, the state of emergency will have a duration 60 calendar days in 7 specified regions. In this period National Police of Peru (PNP) “maintains control of internal order with the support of Armed Forces” (FF.AA.) and will aim to “protect critical national assets”.
In addition rights regarding the inviolability of the home, freedom of movement within the national territory, freedom of assembly and personal liberty and security, enshrined in the Political Constitution of Peru.
It should be noted that the state of emergency has specific features in the department of Puno, where the said measure was already adopted on 14 January. In said jurisdiction, “control of internal order is entrusted to Armed forceswith the inclusion of PNP (…) in the territory declared in a state of emergency,” the regulation specifies.
Exactly the same in Fist will manage forced social immobilization “all people in their homes” for 10 calendar days from 20:00. until 4 am
It further clarifies that during the mandatory social immobilization, people may move for “purchasing, producing and supplying food”, as well as medical personnel and other persons necessary for the continuity of economic activity and services of water, sanitation, agriculture, surveillance and security, financial services etc.
The Supreme Decree also provided that in Fist, Unified Command of the Armed Forces. “take over the Joint Command of the Armed Forces and the National Police”.
Finally, the regulations stipulate that within 5 working days after the end of the state of emergency in 7 regions PNP must submit to the Minister of the Interior “a detailed report on the actions carried out during the state of emergency.”
Also Joint Command of the Armed Forces and the National Police in the department Fist must submit a similar report within the same period to the Ministers of the Interior and Defense.
