The Standing Committee of the Congress will evaluate on Tuesday, February 7, the final report Subcommittee on Constitutional Charges which recommends that former President Pedro Castillo be charged with alleged crimes criminal organization, influence peddling and collusion. The constitutional complaint submitted by the National Prosecutor, Patricia Benavidezgoes all the way to Juan Silva and Gainer Alvarado as former ministers of transport and communications, as well as housing, construction and sanitation, respectively.

Charge against Pedro Castillo

Former President Castillo Terrones is accused of the following crimes:

  1. Against public order in the form of a criminal organization aggravating his presumed leader status, a crime defined in the first and second paragraphs of article 317 of the Criminal Code in accordance with Law 30077, the Organized Crime Law.
  2. Against public administration – crimes committed by public officials in the form of abuse of influence for personal gain, provided for in Article 400 of the Criminal Code.
  3. Alleged accomplice in a crime against the public administration – crimes committed by officials in the form of conspiracy, provided for in Article 384 of the Criminal Code in accordance with Article 25 of the Criminal Code, to the detriment of the state.

Charge against Juan Silva

Former Minister Silva Villegas is accused of the following crimes:

  1. Against the public peace in the form of a criminal organization referred to in the first paragraph of article 317 of the Criminal Code, in accordance with Law 30077 – Organized Crime Law.
  2. A crime against public administration is a conspiracy provided for by part one of Article 384 of the Criminal Code of the Russian Federation to the detriment of the state.

Prosecution against Geiner Alvarado

Former Minister Alvarado López is accused of the following crime:

  1. Against the public peace in the form of a criminal organization referred to in the first paragraph of article 317 of the Criminal Code, in accordance with Law 30077 of the Organized Crime Law.
