The plenary session of the Congress of the Republic approved this Thursday a final report recommending a 10-year suspension from public service for parliamentarian Freddy Diaz, accused of drinking alcohol on the premises of the Legislative Palace and sexually assaulting an employee in his office.
77 votes in favour, one against and four abstentions. Freddie Diaz he will go out of bounds to be replaced by his assistant Nelsie Lydia Haidinger Ballesteros.
“Therefore, a decree will be issued declaring a vacancy and the National Election Jury will be informed in accordance with the law on the relevant procedures,” said Speaker of Parliament José Williams Zapata, who presided over the meeting.
Decision against Freddie Diaz It was adopted after the National Representation approved a revision of the vote taken on Tuesday 10th presented by MP Sigrid Bazan Narro (CD-JP), who archived the proposal for sanctions. This vote had 105 votes in favour, two against and seven abstentions.
Final Report
Earlier, the parliamentary rapporteur read out the final report on the case Freddie Diaz prepared by the Subcommittee on Constitutional Charges, which, in its opinion on the reasonableness and proportionality of the disqualifying sanction, states that the principle of proportionality is observed, therefore they are also reasonable and thus compatible with the Constitution.
In addition, “it has been proven that the exposed congressman abused his power as a congressman of the Republic and his investiture to engage in sexual relations and drink alcohol with a worker under his care, inflicting psychological trauma on her and, above all, using public funds and resources appointed by the Congress of the Republic”.
Likewise, “the exposed congressman was shown to have committed constitutional violations of articles 1, 2 (numbers 1 and 24 (lit. h)), 38, and 39 of the State Political Constitution.”
The document adds that “in addition to the facts that are the subject of the investigation justifying the application of the proposed sanction, additional factors are observed in the behavior of the accused, such as: he is a high-ranking public official who has a great responsibility to act for the benefit of the Peruvians, instead of abusing his position, and the events were carried out inside the office of Congress, abusing the assets assigned to him in connection with his status as a congressman.”
They demand preventive detention
On Wednesday, the public ministry requested nine months of preventive detention for the congressman. Freddie Diaz Monago for the alleged crime of unconscious rape to the detriment of a former employee of his agency.
Such a request was made by the Supreme Prosecutor Zoraida Avalos, who issued a preliminary investigation against the parliamentarian. Interim Chief Justice Juan Carlos Chekli, who called for a private virtual hearing at 12:30 noon, will be in charge of making the decision. However, this was rescheduled for Friday at 20:30.
Prosecutor Avalos, in her support, warned of “substantiated and serious elements of a conviction that link the defendant to the commission of the alleged crime.” He also calculates the “high probability” of escaping and obstructing the investigation.
