Sunedu: TC declares unfounded claim of unconstitutionality of law changing composition of Board of Directors

The Constitutional Court (CC) found unfounded the claim of unconstitutionality of Law 31520, an ordinance that amends the Board of Directors of the National Authority for Higher University Education (Sunedu), which was represented by 25% of the legitimate number of congressmen against the Congress of the Republic and the Executive.

“The lawsuit was filed by 25 percent of the legitimate number of congressmen against Law 31520, the Law restoring the autonomy and institutionalization of Peruvian universities, and Article 32 of Legislative Decree 1451. Because it is contrary to university autonomy. In this process, the Constitutional Court declared the claim unfounded,” the message posted on the official website reads.

Recall that in July of this year plenary session of the Congress approved with 72 votes in favour, 39 against and four abstentions due to the insistence on autographing said law weakening Suneda’s autonomy. A rule restoring autonomy and Institutionality of Peruvian Universitieswithin the fourth paragraph of Article 18 of the Political Constitution by amending Articles 1, 12, 15, 17 and 20 university law.

In August of this year, Jerry Ramonethe rector of the National University of the Mayor of San Marcos (UNMSM), invited Américo Guevara, President of the Association of National Universities of Peru (Aunap), to present the credentials of two members elected by a group of rectors as representatives for integration into the Board of Directors Sunedu.

“In accordance with the provisions of Law No. 31520, approved and promulgated congress of the republic the undersigned rector UNAMSorganized an appropriate meeting of rectors of state universities to proceed with the election of two members who will enter the Board of Directors Suneduevent that occurred at a meeting on Friday, August 19 of this year,” the document says.
