The deputy explained that the project does not interfere with the theoretical test of any public exam, allowing broad competition in an equal manner. “This project does not prohibit trans people from taking part in public exams or make it more difficult for them to enter public administration, but it changes the criteria during physical or practical tests, guaranteeing the principle of equality when the physical characteristics of each gender may generate disadvantages,” said Menezes.
Bill No. 372/2024 was presented on June 3, 2024, and will be analyzed by thematic committees of the Legislative Assembly of Amazonas (Aleam). Similar projects have been presented in other states, such as Minas Gerais and Pernambuco, but they face legal barriers. In 2017, the Superior Court of Justice (STJ) concluded that psychosocial identity prevails over biological identity, allowing gender change in public documents without the need for medical intervention.
In 2018, the Superior Electoral Court (TSE) ruled that political parties’ candidate quotas are based on gender, not biological sex. If brought to court, Menezes’ bill could be considered unconstitutional for violating constitutional precepts.
“The LGBT population still survives on underemployment and is involved in entrepreneurship because they are unable to access formal employment policies. How many trans people are able to compete on equal terms in a public exam?” asked Gomes.
