Deputies sue STF over ban on LGBT+ marriages

Report in question gives priests, pastors and religious leaders the freedom to choose whether or not to celebrate the union

Federal deputies Pedro Campos and Tabata Amaral, both from PSB, are trying to suspend, with an injunction in the Federal Supreme Court (STF), the report by deputy Pastor Eurico (PL), which prohibits same-sex marriage. Approved last year by the Social Security, Childhood, Adolescence and Family Commission (CPASF), the document provides for the prohibition of homosexual marriage and also gives priests, pastors and religious leaders the freedom to choose whether or not to celebrate the union.

In the preliminary measure, Tabata and Pedro claim that the issue is not the material constitutionality of the project, but the “the impossibility of the enforcing authority to submit to a vote a legislative proposal that violates the due constitutional legislative process, given that it relegates matters within the competence of the Plenary to the Commission, in addition to the flagrant intention of altering and deleting an immutable clause”.

In an interview with Rede Pernambuco de Rádios and Alberes Xavier’s blog, deputy Eurico stated that his vote against the recognition of homosexual marriage was in accordance with the constitution, which “only recognizes the union between a man and a woman”, according to his words.

“I gave my opinion, and the project was discussed. We had public hearings and there was a lot of discussion in the committee which, in the vote, was in favor of our report, rejecting the issue of gay marriage, which was an old project of Clodovil”, reported Eurico.
