The Senate Public Security Committee (CSP) approved on Tuesday (14/5) a plenary amendment to the complementary bill that creates protection mechanisms for the incarcerated LGBT+ population. Now, the matter returns for analysis in plenary. The amendment had already been approved last month by the Human Rights Commission (CDH).
PLP 150/2021, authored by senator Fabiano Contarato (PT-ES), amends the National Penitentiary Fund (Funpen — Complementary Law 79/1994) to determine the construction or adaptation of prison wings for the incarcerated LGBTQIA+ community, in an appropriate quantity and the autonomy of declaring identity is respected.
The amendment, suggested by Senator Weverton (PDT-MA), determines that the cells intended for this portion of the incarcerated population must have the same health conditions as the other wings. The senator explains that the measure prevents spaces from being used as a form of discrimination, by allocating unhealthy spaces specifically for the LGBT+ population.
The text proposes, with Funpen resources allocated to the national penitentiary system, the training of prison system professionals on human rights and equality, whether in relation to the issue of gender, religion, race, ethnicity, sexual orientation and gender identity.
The proposal also mentions, as a condition for states and municipalities to receive funding from Fupen, the publication of an annual report on activities to combat discrimination based on sexual orientation and gender identity, including cases of violence within the prison system.
