A federal court in Vermont on Wednesday awarded the couple living in Florida $ 5.25 million to a doctor who used their own sperm for fertilization during a 1977 artificial insemination procedure.
Burlington Federal Court began the hearing Tuesday and overturned the verdict Wednesday.
The sentencing form, filed in Burlington Federal Court, states that the jury paid plaintiff Cheryl Rousseau and her husband Peter $ 250,000 in damages and $ 5 million in damages from Dr. John Coates III.
Rousseau’s attorney Celeste Laramie said in an email after the verdict announced Wednesday that the jury had awarded the required amounts and that the jury considered it “wrong and abusive.”
“The jurors sent a message with an injury verdict to any doctor who might think they were fooling patients or using their own sperm to fertilize their patients,” he said. “Such behavior will have serious consequences.
Coates’ attorney did not say whether they intended to appeal the verdict.
“We are shocked and disappointed with the verdict,” attorney Peter Joslin said in an email.
The Vermont Medical Practice Board met regularly last month. Coates’ medical license was revoked. Coates, who worked in obstetrics and gynecology in central Vermont in the 1970s, is now retired.
Coates also addresses the latter, A similar case was filed last year that is still pending in Vermont District Court of the United States.
The initial complaint states that Coates agreed to allow Cheryl Rousseau to enter donor material from an unnamed medical student who appeared to be Rousseau’s wife and had the qualities she needed.
Rousseau wanted to have a child with his wife, but he underwent a vasectomy, which could not be changed, according to the complaint.
Coates performed artificial insemination but inserted his own genetic material, the alleged reason.
Rousseau’s lawsuit says they found out what happened when their daughter now searched for substantial information about her biological father through DNA testing. The daughter Coates found out her father, according to the lawsuit.
