LOS ANGELES (AP) – A judge on Friday dismissed part of the lawsuit against Kim Kardashian in a case filed by former reality TV star Black Chana before the jury heard the remaining elements.
Judge Gregory Alarcon ruled that the Chinese lawyer, Lin Xi’an, did not make any defamatory statements against Kardashian during the trial.
The jury went home Friday, without a verdict, after the first full day of the hearing. Their instructions were changed after Kim Kardashian’s decision, and lawyers and a judge answered some questions they asked. Their update is scheduled for Monday morning.
The Chinese lawsuit alleges that women falsely told TV producers and executives that Chana violently assaulted her then -boyfriend Rob Kardashian in December 2016 to cancel her reality show “Rob & Chyna”.
Cyan argued in a final discussion Thursday afternoon that the women had no reason to believe in the attack because testimonies, photos and videos from the time showed no significant harm to Rob Kardashian.
“He has no sign of it,” Cyan said. “No police calls, no hospital trips, no gangs.”
Kardashian’s lawyer Michael Rhodes argued at the time of his closing that the women had every reason to believe reports of the attack on Rob Kardashian and Chris Jenner’s longtime friend Corey Gamble who broke up.
“Do you remember how Robbie looked yesterday at the booth?” “His pain is real,” Rhodes said. “This is a real family. Yes they are famous but real people. “Here he was seriously wounded.”
Ciani gave us clear examples of text and email announcements from Chris Jenner, Khloe Kardashian, and Kylie Jenner who told the show’s producers and E! The network on which the show aired speaks out about allegations of abuse.
But the case he filed against Kim Kardashian is more vague.
After Alarcon read the jury’s instructions on Thursday, Rhodes said there was no potentially defamatory statement from Kim Kardashian.
Cyan was outraged by the statement, but a failed judge reprimanded him, and said he accepted the jury’s instructions prior to the trial.
A similar argument emerged in court on Friday about Alarcón’s unusual approach to selecting jurors. Instead of electing 12 jurors and four alternates, the attorney-judges selected 16 jurors and then, after final arguments, they randomly selected four alternates. The judge reiterated to Cyan that he accepted the trial before the court.
In the civil case, nine of the 12 jurors had to agree that Kardashian’s three defendants knowingly lied to Chana about insulting Rob Kardashian, or spread the word about it through reckless disregard for the truth. The same number must decide whether it is illegal to interfere with Chinese E! Net.
