congressman Hernando Guerra Garcia (People’s Force) was against parliamentarians having an spending initiative. This is in connection with the decision of the Constitutional Court (CT), which opens up the possibility for legislators to enact laws that generate costs.
AT News extensionfujimorista warned that this could generate “Congressional demagogy,” given that many of the laws introduced by the so-called “fathers of the nation” are “declarative.”
“It seems very dangerous to me. I think that if there is one thing that kept the economic growth model, despite all the nonsense that this government is doing, and we had stability, it is the avoidance of demagoguery, ”commented Guerra Garcia.
“There we cannot fall into the dictatorship of the Congress, but we can fall into the demagoguery of the Congress. Congressmen shouldn’t have any spending initiative. When we see some qualities of projects, when we see so many declarative projects, we are going to return to the previous model, in which every congressman wanted to build a bridge, and there is no budget to support it, ”he added.
For a congressman spending initiative should be the exclusive prerogative of the executive branch.
CT malfunction
constitutional Court he interpreted Article 79 of the Constitution and thereby gave congressmen a free hand to develop bills with the possibility of spending funds, which was prohibited by the Magna Carta itself.
For CT, Article 79 “does not preclude that a legislative initiative presented by congressmen may constitute a legitimate source for subsequently and within the limits of its powers, the executive branch to determine or consider the inclusion of the necessary items in the law on the annual budget to meet expenses that, over time, require their materialization .
In other words, a congressman’s spending initiative is prohibited only if he intends to change the current budget, but not the budget of the next year or several years.
