The executive branch promulgated a law establishing retirement norms workers who work in the field of civil engineering, under a special regime.
Act No. 31550, approved by Congress, establishes that workers in this sector will now be able to access retirement upon reaching the age of 55.
To do this, workers must prove 180 months of service with contributions to the pension system, whether AFP or ONP.
Of the mentioned 180 months of contributions, which corresponds to 15 years of contributions, at least 72 months must be provided in activities civil construction. That is, formally, the employee must work for at least 6 years in construction.
How will the pension be calculated?
The rule states that the last 60 benefits or insurance income received are taken into account to calculate the amount of pension that employees retiring under this regime would receive.
In addition workers they will receive all the benefits corresponding to each pension system, whether public or private.
To implement this law, the executive branch must approve regulations within 60 days.
How many builders?
According to the latest data from the National Institute of Statistics and Informatics (INEI), the construction sector employs about 1,235,000 workers at the national level.
Until the first quarter of the year, from January to March, 25.4% more workers in this sector than in 2019, but not all of them are formal.
It is estimated that only about 161,800 construction workers are officially employed in urban areas, representing only 4.1% of the formally employed population.
About 944 thousand builders work in conditions informality and they will not be able to access the aforementioned pension regime, since only formal persons make regular contributions to the pension system.
The number of informal construction workers increased by 42.2%, compared to last year’s data before the pandemic.
It is worth noting that these informal workers do not have Labor benefits, that is, they are not connected either with insurance or with the pension system, they do not receive any allowances, or KTS, and even the minimum wage may not receive. At present, the average income of a construction worker is 1,614.2 somoni.
