This week we have a new non-working day, after Government promulgate a law declaring August 6 a national holiday.
The holiday was established in Law 31530, which enshrines legislation on paid breaks employees who are subject to the labor regime of private activity.
Why is it a holiday?
As stated, a new national holiday was established to commemorate the Battle of Junin.
It was one of the last clashes between royalist and patriotic armies in the process of Peru’s independence in 1824. This event set an important precedent for Battle of Ayacucho.
The law specifies that the ministries of education, culture and defense will be responsible for planning official events dedicated to the Battle of Junin and its historical significance, which will be held in public and private educational institutions and in all public sector organizations.
How much will they have to pay me?
In the event that you qualify for work during your next holiday, the National Labor Inspectorate (Sunafil) indicates that you should be paid triple the amount.
“If you work on a public holiday, without compensation for another day of rest, you should receive triple pay: 1 remuneration for the holiday (already included in your monthly reward) + 1 bonus for the work done + 1 bonus as an additional payment,” Sunafil clarifies.
For example: if your monthly salary is SGD 1200, you earn approximately SGD 40 per day. If you work during your holiday without changing that day to a day off, then you will receive two additional payments of 40 S / for that day, that is, in one day you will earn 120 S / 120.
Another option for companies is to exchange a working day for a new day of rest. This only applies if the holiday does not coincide with the worker’s weekly rest.
