The National Commission, which conducts state regulation in the field of energy and utilities, gives a violation of NEC certification for Ukrenergo as an independent system operator when the Supervisory Board of the Company Management and intention of considering considering these transformations of law. This is stated in the NKRECP’s state statement on Monday, September 29.
“Sudden decisions of staff about the chairman and members of the NEC Ukrenergo Board seem to be a violation of certification policies, which requires further study. Such a course of events will endanger the confidence of international partners and dangerous electricity imports on the eve of the heat period,” the statement said.
According to the regulator, NEC Ukrenergo is obliged to accept changes to managerial staff with the condition to be exposed and inform the commission on their basis in advance. However, these requirements of the law of standards in Ukraine and EU are not fulfilled.
“There are no changes in the leadership composition that can endanger the stability and operation of the energy system. In this regard, the NKRECP will soon consider the situation in compliance with the requirements of the NEC Ukrenergo law,” the report added.
Thus, according to part of three in Article 35 of Ukraine Law “In Electric Energy”, the OSP is obliged to inform the NKRECP any changes that may affect its department and independence. According to the final decision on the transfer system certification (NKRECP Resolution No. 2589 dated December 17, 2021), the Ministry of Energy and Ukrenergo is obliged to notify the appointment or removal of board members within three business days and provide with -the -way documents.
In addition, Chapter 8 of the method for OSP certification (NKRECP Decree No. 1016 of August 10, 2017) establishes its obligation to inform the regulator within 10 working days from the date of receipt of information, especially, to change or intend to change the composition of the executive body.
The NKRECP also indicates the provisions of Article 19 of the Directive of the European Parliament and the Council of 2009/72/EU of July 13, 2009, according to which the regulator has the right to express objections within three weeks, in the event of a premature end of powers, if the doubts arise about its trueness. Therefore, appointment decisions or concluding the powers of members of the body rulers are forced only after the end of this period
It should be noted that on September 26th, Nek Ukrenergo’s Supervisory Board fired Vitaly Zaichenko from the post of the Board Chairman and appointed Alexei Brecht to the temporary act.
