Tiktok violated the EU’s major policies for data protection when he sent European users to China.

Tiktok must pay a fine of 530 million euros for illegal transfer of European personal data to China and inadequate transparency to users. It was said by an influential Irish regulator in confidentiality, politician reports.

According to the Irish Data Protection Commission (DPC), Tiktok violated the EU’s major policies for data protection when he sent European users to China, it could not ensure that the data was protected against the background of China’s monitoring laws.

In the first instance of taking a data transfer position to China, the regulator said the Tiktok could not assess the consequences of Chinese monitoring laws for Europeans. These laws, which provide extensive power by the Chinese government to order companies to transfer data, “significantly deviating from EU standards,” Tiktok admitted during the investigation.

The regulator also said Tiktok violated the rules of transparency from 2020 to 2022, as he did not tell users about transferring personal data to China. He noted that Tiktok updated his confidentiality policy in 2022 and now “meets the requirements.”

The company is punished by 485 million euros for transferring data to China and 45 million euros for lack of transparency in the policy of confidentiality.

As you know, this fine is the third largest violation of EU’s overall regulation for data protection. Tiktok’s headquarters are located in Ireland, which means the Irish DPC is the leading body responsible for compliance with EU policies.

For many years, the company claimed that it did not store Europe or American users on servers in China, but in April, the regulator was informed that in February it was found that “limited data from EEZ users” was actually stored in China.

According to Graham Doyle, DPC Deputy Irish Commissioner, the regulator saw this discovery “serious”, and although Tiktok said he had removed data from Chinese servers, the regulator considers “receiving additional regulation steps.”

Tiktok has been given six months to bring your data processing skill in accordance with EU policies for privacy or suspend the entire data transfer to the country.

The company said he was “determined to reject” the conclusions of the Irish DPC and plans to appeal in full.

“In addition to the DPC’s inability, with the merits of consideration of major guarantees (implemented by Tiktok), we have failed that we are defined as unlawful, despite the fact that we rely on the same legal mechanism used by thousands of other companies that provide European services in Europe,” said Christina Grande, head of state policy policy and Tiktok government policy.

Tiktok pointed out his investment with a volume of 12 billion euros on the Clover project, which opens European data processing centers for local data store in the EU, as well as other guarantees of confidentiality. The Irish DPC recognized the effectiveness of the project, but indicated that it was not sufficient to influence its decision.

Gran emphasized that Tiktok “has not yet received requests for European users from Chinese authorities and has never been given data by European users.”

According to him, the Irish DPC’s decision “risk creating a preceding distant consequences for companies and entire industries across Europe working on a global scale,” and “struggling with the European Union’s competition.”

Earlier it was reported that the Chinese Company bytedance LTD, who was the Tiktok Maternal Company, was a wife to the European Union for more than 500 million euros for the illegal transfer of European users to China.

Earlier it was reported that the Albanian government had decided to hinder the Tiktok within 12 months, accusing the platform of spreading violence and oppressing children.
