The City Council not only recognizes the actual termination of the lease relationship, but also announces the extension of the lease agreement.
The Tekhnova company declares that it has fulfilled all obligations in accordance with the agreement on the termination of the lease agreement for the unified property complex of the utility power generating enterprise Chernihiv CHP dated December 25, 2000 No. 1 and considering that the UIC lease agreement was terminated on March 31, 2023.
This is the reason for the initiation before the NEURC of considering the issue of license suspension for the right to conduct economic activities for the production of electricity and heat. The meeting on this issue was held on April 17-18, 2023 with the participation of Tekhnov LLC and the Chernihiv City Council.
However, immediately after the NEURC meeting, the press service of the city council rushed to inform the public about the participation of its representatives in the meeting, distorting almost all information about the actual situation in Chernihiv CHPP.
In particular, it concerns the irregular, according to Mr. Gerashchenko, debt for consumed coal, which the city council allegedly learned for the first time at a NEURC meeting. Despite the fact that the Tekhnova company has repeatedly informed the Chernihiv city council that this debt remains with the business and is not transferred to the balance sheet of the utility company, regardless of the amount of the debt – UAH 360 million or more.
This also applies to UAH 500 million, which Tekhnova must allocate for the restoration of the thermal power plant by the decision of the NEURC. The fact is that UAH 500 million is a virtual amount artificially calculated by NEURC and does not have any economic justification. Currently, there is no such mechanism to return the property at the cost of money that exists only on paper.
Unfortunately, the ability of the Deputy Chairman V. Gerashchenko is not enough to understand both the nature of such a debt and the actions that Tekhnova LLC is now taking in the interests of a new utility company, challenging the virtual debt that it in the courts.
As for the nature of the debt, this is exactly the case when the state, represented by the state company Energorynok, owes hundreds of millions of hryvnias to Tekhnov for the supplied electricity, leaving it without working capital, which should have been used for repair. equipment and purchase of coal, and then, already on behalf of the supervisory authority, penalized Tekhnova LLC for these unfinished repairs in the amount of underfunding.
Meanwhile, Technova transfers not only accounts payable, which is the subject of discussion, but also accounts receivable, including UAH 123 million from State Enterprise Energorynok, Ukrenergo NPC – UAH 343 million, household debt for consumed heat – UAH 126 million. Only the tariff difference, which was agreed by the territorial commission on March 14, 2023, amounted to almost UAH 242 million.
City council representatives V. Gerashchenko, A. Yepinin, taking advantage of their participation in the NEURC meeting, continue to justify their criminal inaction, manipulating information to build their positive image to the townspeople.
Tekhnova LLC emphasizes that this is how the activity of the Chernihiv City Council is characterized today on the issue of the termination of the lease agreement for the unified property complex of the utility power generating enterprise Chernihiv CHP. Instead of resolving the issue, the City Council not only recognized the actual termination of the lease relationship, but also announced the extension of the lease agreement beyond August 20, 2023 (the lease end date -upa specified in the agreement), which justifies it has martial law.
Another fact of such inaction is the appeal (letter No. 527 / 2-14.01 / vy / 01 dated April 18, 2023) of Chernihiv City Council to Tekhnova LLC with a request to provide explanations for the termination of thermal and electrical energy generation. And this is after Technova keeps informing the city about the state of affairs and calls for the necessary decisions to be made:
– by letter No. 217/1 dated 03/20/2023, the Company reported that due to the early termination of the lease agreement, the relevant applications were sent to the licensing authority to stop the license for heat and electricity production from 04 /01/2023;
– during the meeting on March 23, 2023 on the status of transfer of UIC Chernihiv CHP with the participation of V. Gerashchenko, information was announced about the response from NPC Ukrenergo that the construction of the equipment of Chernihiv CHP after the end of the heating season 2022/2023 can be stopped as a reserve;
– in the period from April 3 to April 11, 2023, through letters No. 275, no. 276, No. 277, No. 285, No. 289, No. 292, No. 300, no. 303, No. 307 , the company applied for the receipt of UIC from the lease to the Communal Property Fund of Chernigov City legal advice for the possibility of its transfer to a new balance holder.
Today, Technova has stopped generating heat and electricity, as it does not have the right to use the UIC Chernihiv CHPP equipment. Therefore, the company only provides UIC repair and storage.
We emphasize again: Technova LLC ensured the transfer of all the necessary documents for the assessment, provided all the information necessary to ensure the termination of the lease agreement, and is ready to transfer to the EIC.
