In 2016, Igor Kolomoisky, who at that time was a co-owner of PrivatBank, signed surety agreements with the NBU, where he personally guaranteed the repayment of loans received by the bank.
The Supreme Court upheld the cassation appeal of the National Bank and confirmed the legality of five loan agreements with PrivatBank for UAH 18.3 billion and guarantee agreements ensuring their implementation. This was reported on the NBU website on Friday, April 7.

It is indicated that the Supreme Court overturned the decision of the lower courts, which satisfied the claim of the former shareholder of PrivatBank Igor Kolomoisky and annulled these agreements and his personal instruction on loans.
The NBU recalled that in 2008-2015, under the disputed agreements, they provided loans to PrivatBank to maintain liquidity in the total amount of UAH 18.3 billion.
In 2016, Igor Kolomoisky, who at that time was a co-owner of PrivatBank, signed surety agreements with the NBU, where he personally guaranteed the repayment of loans received by the bank.
But in May 2019, Kolomoisky filed a lawsuit in the Kiev Economic Court to annul these loan agreements, as well as the guarantee agreements. In June 2020, the court satisfied the former shareholder’s claim for the first time. This decision was upheld by the Court of Appeal. The NBU appealed this to the Supreme Court, which upheld the regulator’s legal position.
In April 2020, the state-owned PrivatBank fully returned the loans received from the National Bank.
It will be remembered that in February 2023, the Supreme Court confirmed the legality of the nationalization of PrivatBank. This decision made it impossible for the bank to return to its former owners.
