According to a study by Ipsos Peru, 33% of Peruvians pay for purchases with debit cards, while 15% use credit cards. Sometimes this may include I’m crying optional, but is it legal?
In some cases, businesses such as wineries or commercial premises choose to charge an additional 5% fee to those using the card. However, Indecopi indicates that this must be notified before purchase.
The Consumer Protection and Protection Code states that the shops who use them must notify customers as soon as they enter the establishment. This must be indicated using visible letters or other means of communication that allows the user to recognize the terms.
“In the event that a supplier differentiates the price of a product or service on the basis of means of payment such as credit cards or others, said information must be communicated to the consumer in a conspicuous place, in a visible and accessible form on the premises. ..or commercial establishment, through posters, advertisements, etc. In case of non-compliance by the supplier with the requirements, consumers cannot be forced to pay additional amounts, and the established price for the product or service must be respected, ”says Article 7 of the aforementioned code.
It is worth noting that companies that do not provide clear and timely information may be subject to Indecopi sanctions in the form of a warning or a fine of up to SGD 2,227,500 (UIT 450).
For its part, digital payment company Niubuz also believes that the additional usage fees map they are not justified.
“In short, these are wrong and unfounded accusations. In the case of Niubiz and VendeMás de Niubiz, we have an agreed commission at the establishments for every sale they make,” they said last year.
The platform specifies that when a company displays the prices of its products, this amount should already include applicable taxes, commissions and fees, so consumers should not be forced to pay an additional surcharge.
