The Cabinet of Ministers submitted to Verkhovna Radov from Ukraine a bill No. 13673 “On amendments to the Code of Administrative Crimes, the Criminal Code of Ukraine, the Criminal Code of Ukraine and other laws of Ukraine on responsibility for crimes related to the crossing of the state border of Ukraine”.
Currently, only administrative liability and fines are provided for illegally crossing the state border.
This bill provides that in military time criminal liability is introduced for:
- an attempt to illegally cross the border beyond the control points or with fake documents (will be punished with a fine of 51 to 170 thousand dollars or imprisonment for up to three years);
- damage to the border infrastructure (will be punished with a fine of 7 to 85 thousand UAH or restriction of freedom for up to three years or imprisonment for the same period);
- Violations of conscripts, conscripts or reservists of the conditions of staying abroad during martial law (will be punished with a fine of 3.4 thousand to 5.1 thousand or imprisonment for up to five years).
The bill was prepared by the Ministry of the Interior.
Today, unfortunately, we see massive attempts to avoid mobilization through an illegal trip abroad. As practice shows, administrative fines do not limit violators, a message published by the Ministry of the Interior was said.
The Ministry of the Interior notes that the new bill proposes a “systematic solution”:
- Transfer of consideration of administrative administrations for illegal crossing of the border to border guards. The Department claims that it is “faster and more effective”;
- the establishment of criminal liability in wartime for illegal departure, the use of fake documents or damage to the border infrastructure;
- The introduction of a new norm for conscripts – violations of the permitted stay abroad will also have legal consequences.
At the same time, the bill provides a balance: those who voluntarily return to Ukraine can avoid criminal liability, – the Ministry of the Interior is emphasized.
Our responsibility is to ensure the security of the state and maintain its protection at the most difficult time, ”they added to the department. – The parliament will determine the fate of this bill.
