The high council of justice opened a disciplinary case against a judge who from the very beginning of the occupation came to the Crimea.
We are talking about the judge of the sixth administrative court of court Yaroslav Vasilenko. The Supreme Council of Justice opened a disciplinary case against him on a complaint against a judge filed by the Avtomaydan NGO after leaving the investigation of the scheme.
In it, journalists found that the judge had arrived in Crimea from the very beginning of the occupation 25 times and does not declare an apartment in Sevastopol, registered on his wife, who has citizenship of the Russian Federation.
Such actions of the judges, declared in the complaint, have “signs of disciplinary crimes provided for by certain clauses of the Law of Ukraine” to judicial power and the status of judges ” – in particular,“ recognition of the judge to judge or undermines the powers of justice ”and rejects false information or“ deliberate information.
The GRP resolution also said that the State Border Service confirmed Vasilenko’s repeated visits to the occupied peninsula.
At the request of the Supreme Council of Justice, Vasilenko did not answer, and therefore GRP members took into account the explanation of the judge, which he provided NABU detectives, who, after the investigation of the scheme, opened the criminal case against Vasilenko for a probable false declaration.
The judge explained that from 2014 to 2021 he repeatedly visited Crimea, “because his wife was born there.” He also said that he was resting in Sevastopol in the apartments of his wife, who did not show him. In Crimea, “he was engaged in diving, fishing, visiting the family cemetery.”
The second disciplinary chamber came to the conclusion that judges in occupied Crimea are regularly trips without urgent necessity “can testify about the absence of a clear civil position, ignoring the violations of the Russian Federation of the rights and freedoms of Ukrainian citizens in the occupied territory and the inability to fulfill judicial ethics.
From the decision of the disciplinary chamber, it became known that on September 5, 2023, NABU closed a criminal case against Vasilenko from the absence of a criminal offense in his actions. The closure of the NABU detective was approved by the fact that it was not submitted to verify the information of the “schemes” during the preliminary investigation in connection with the military aggression of the Russian Federation against Ukraine. ”
At the same time, based on the facts of visiting the judge of the occupied Crimea, the chamber decided to open a disciplinary case against Vasilenko.
