Soldiers who create technological solutions for the army will receive the right to reward for a fair author.
Such changes are initiated by the Ministry of Defense. This was announced today, March 20, the department of the department.
Today, military personnel of scientific institutions, specialized technological centers, technical seminars and other defense forces are working on solutions that help destroy the enemy. However, the rights of intellectual property to these decisions remain unprotected, unlike the civilian sphere, ”the Ministry of Defense emphasizes.
Two bills were registered in Verkhovna Rada to solve this problem – No. 13110 and No. 13111 – on amendments to the Civil Code of Laws on Ukraine and Profile. They provide for the following distribution of intellectual property rights:
- Personal unsurpassed rights (authorship, maintaining the integrity of work) will belong to a military personnel who is the author or inventor of such an object;
- Property rights (use, licensing) will be acquired by the state in the person of the Ministry of Defense (or another body where the person undergoes military service).
Amendments to the legislation will ensure the payment of fair remuneration of military personnel for the rights of intellectual property they created. Installations will also be eliminated for scaling technological solutions from the clear authority of the Ministry of Defense for the release of licenses, the department says.
The bills were developed jointly by the Department of Intellectual Property of the Main Directorate of Military Justice, the Ukrainian National Administration of Intellectual Property and Innovations and the Institute of Legislative and Scientific and Legal Experience of the National Academy of Sciences of Ukraine.
