The official status of the defendant, such as the status of head of state, will not defer him to criminal responsibility, the Foreign Minister said.
Foreign Minister Dmitry Kuleba called for the creation of a special tribunal for the crime of aggression against Ukraine to bring the leading military and political leadership of the Russian Federation into compliance and named future parameters. He said this in a speech to conference participants in The Hague about Russia’s responsibility for crimes in Ukraine, the Foreign Ministry reported on Thursday, July 14.
In particular, the minister named five main parameters proposed by Ukraine to be the basis of the future special tribunal:

The Special Tribunal shall be based on the rules and procedures applied by the International Criminal Court and shall be set forth in its Rome Statute. It will investigate and prosecute crimes of aggression against Ukraine committed on its territory, as defined by Article 8 bis of the Rome Statute.

The jurisdiction of the special tribunal will extend to all events from February 2014, the beginning of Russia’s armed aggression against Ukraine.

The Special Tribunal shall have jurisdiction over natural persons who exercise effective control over or directly oversee the political or military affairs of a State.

The official status of the defendant, such as a head of state, or the official status of another state official, shall not disqualify such person from individual criminal liability and will not mitigate the penalty.

The Special Tribunal will only consider crimes of aggression against Ukraine and will be established as an international ad hoc special crime court to consider Russia’s armed aggression against Ukraine.
“Thousands of innocent victims of this crime of aggression deserve justice. The international community as a whole also needs justice to punish the biggest violation of international law since World War II. We must end impunity and leave it to the next. that generation is the world where the rule of law will always reign, ” – summed up Kuleba.
It was previously reported that more than 40 countries have supported Ukraine’s lawsuit against Russia in the International Court of Justice.
