The appeal of the Nord Stream 2 operator has been returned for consideration in a court of general jurisdiction of the European Union.
A European Union court has recognized Nord Stream 2 operator Nord Stream 2 AG’s claim regarding the EU gas directive as “partially admissible”. Consequently, the court reversed the earlier decision dismissing the claim. The corresponding court decision was published on Tuesday, July 12th.
As follows from the document, the appeal was returned for consideration in a court of general EU jurisdiction.
“Nord Stream 2 AG is particularly concerned about the terms of the exemption or reduction, amended or included in the amended directive, as a result of which its claim for repeal must be recognized as justified within of this separate concern, “the court said in the decision.
Recall that Germany stopped certification of Nord Stream-2 even before Russia’s invasion of Ukraine began, and after the start of the war with the United States, they said the SP-2 was “dead.”
The directive began in 2019. The document expands the rules of the domestic natural gas market in the pipelines of third countries. Thus, the document extended the EU Third Energy Package standards to gas pipelines coming from other countries. In 2020, the court rejected the Nord Stream operator’s claim to challenge the directive. In 2021, the company tried to get exemption from the directive in Germany, but lost in court.
