Senior officers in Russia have the right to be dismissed no earlier than 70 years of age, and other military personnel – at 65 years of age.
Russian mobilized and contracted soldiers of lower ranks serving under conditions of mobilization, martial law or wartime can retire from the army only upon reaching 65 years of age. This is confirmed by the decision of the Constitutional Court (CC) of the Russian Federation regarding the complaint of a contract soldier about the refusal to be dismissed from service when the age limit is reached, Telegram channel reports Military lawyers.
The contractor requested to recognize as unconstitutional Article of Federal Law No. 269 (FZ-269), according to which senior officers have the right to be dismissed no earlier than 70 years of age, and other military personnel – at 65 years of age in the conditions of “shared mobilization. ”
The applicant noted that the imposed restrictions contradict the Constitution, since they apply to contract soldiers who entered into an agreement with the Ministry of Defense before the beginning of “shared mobilization” and the adoption of Federal Law-269.
Prior to the changes in the law, contract military personnel could be demobilized upon reaching 50 years of age.
The Constitutional Court did not answer the applicant’s complaint. The court said that this document “cannot be considered discriminatory.”
As is known, according to media reports, North Korea may send a total of up to 100 thousand of its military to support Russia’s war in Ukraine.
