Irina Mudra, Deputy Minister of Justice of Ukraine, spoke about it in an interview with La Repubblica.
This model involves the creation of an international compensation mechanism for Ukraine and a commission to consider compensation claims.
“Countries that sign the agreement will have the right to confiscate Russian state assets and transfer them to a recovery fund,” the deputy minister said.
He added that the damage was estimated at $ 92 billion by the end of May, but it was rising daily.
“The responsibility for all this massive destruction must be placed on Russia, and therefore one of the priorities is to create a commission to compensate for the damage caused by the occupiers. According to the deputy minister, an agreement between Ukraine and interested states, especially those holding frozen assets of Russia, will provide the legal basis for the transfer of assets to the compensation fund.
“And, if necessary, also adopt a special confiscation law, as Canada did recently. The United States also has very progressive procedures in this matter, and based on the resolution adopted in May to combat impunity for war crimes in Europe, the European Parliament has appealed to the Commission with a request to immediately develop a legal instrument providing for the allocation of Russia’s fixed assets to finance the recovery, ”he stressed of the deputy minister.
At the same time, Mudra expressed concern that Russian reserves frozen abroad would not cover all the damage.
“Because the Russian reserves that can be used in the world are minimal. At the same time, there are several billion dollars owned by the Russian oligarchs. These are private assets that are more difficult to confiscate. The issue of confiscation of assets Russian-owned oligarchs are a continuation of the punitive regime already in place in Europe.A further step is the transition from arrest to confiscation in cases of more serious violations of the law.Punages will certainly be strengthened by introducing asset confiscation for those who violate them.
