The Pechersky District Court of Kyiv today, October 11, sent serviceman of the 56th brigade Sergei Gnezdilov, who had previously publicly announced the abandonment of the military unit, into custody in the guardhouse. He is suspected of desertion.
This was reported by the publication “Public”.
It is noted that:
- the prosecutor’s office asked for 60 days of detention for Gnezdilov – until December 12 – without the right of bail;
- the defense requested that the motion be dismissed;
- The prosecution believes that detention, in particular, will eliminate the risk of concealment. The prosecution referred to the fact that Gnezdilov, after the SZCh, constantly changed his location and contact information;
- The military’s lawyer, Alexander Shadrin, indicated that the court could set bail. He also asked to take into account the context – Gnezdilov went to the front at the age of 19, having signed a contract with the Armed Forces of Ukraine for three years, and was supposed to retire in 2022. In addition, Gnezdelov is still under 25 years old;
- At the beginning of the hearing, Shadrin’s lawyer filed a motion to disqualify the judge. He explained that the consideration of the court case should have taken place immediately after the arrest of the serviceman, but this happened only a day after the arrest. Therefore, according to the lawyer, there is reason to believe that the prosecution is trying to select a specific judge to try this case;
- the court refused to satisfy this request;
- also rejected the transfer of consideration to the Shevchenko District Court;
- Shadrin also emphasized that Gnezdilov was detained without a judge’s order, and in the arrest report they did not write what exactly he was detained for (except for indicating the article number of the Criminal Code). At the same time, prosecutors insisted that the decision was given by the Solomensky District Court, which confirmed the legality of these actions;
- the lawyer also stated that Gnezdelov underwent surgery. The prosecutor replied that there would be medical workers in the guardhouse who would provide the necessary supervision, so that this would not interfere with the detention.
Acquaintances of Gnezdelov and women military personnel came to the trial, calling for the establishment of clear terms of service. They held posters with the corresponding slogans:
- “Terms of service are the right to life”;
- “He went to the SZCh because the authorities do not hear the request from the military.”
A number of people volunteered to bail Gnezdelov.
Gnezdelov said in the courtroom that he was ready to return to military service if the Ministry of Defense presented a legislative initiative to establish clear terms of service.
They promised to do this 8 months ago and didn’t do it. Clear terms of service. I am in favor that, finally, in our country there will be responsibility not only for the military who went to the SZCh, but also for the Supreme Commander-in-Chief, who promised this (clear terms of service – ed.) to the military. And also for the Minister of Defense, who also promised. “I want us to finally be heard,” he emphasized.
When asked whether he was counting on charges of SZCh, and not desertion, which he is accused of in the investigation, Gnezdilov replied:
I think we will reclassify the case. Because I have publicly articulated everywhere that I have plans to return to the service, and for how long I will be leaving the service. Therefore, here I disagree with Mr. Prosecutor. (When the law on service life is adopted – ed.) or when I turn 25.
