The High Council of Justice decided to resign Inna Otrosh from the post of judge of the Economic Court of the city of Kyiv.
11 members of the GRP voted for this decision. Three members of the High Council of Justice spoke out against it: Inna Plakhtiy, Vitaly Salikhov and Sergei Burlakov. Otrosh was fired on the basis of subparagraph 4 of paragraph 16 of section XV “Transitional provisions” of the Constitution of Ukraine. This was reported on the website of the High Council of Justice.
It is noted that, according to this paragraph, the suitability of the position held by a judge who is appointed to the position for a period of five years or elected as a judge for an indefinite period before the entry into force of the Law of Ukraine “On Amendments to the Constitution of Ukraine (regarding justice)” must be assessed in the manner prescribed by law . The identification, based on the results of such an assessment, of a judge’s inadequacy for the position held based on the criteria of competence, professional ethics or virtue, or the judge’s refusal to accept such an assessment is grounds for dismissal of the judge from office.
As you know, Inna Otrosh is the daughter of the famous head of the Pechersky District Court of Kyiv Inna Otrosh, who during the presidency of Viktor Yanukovych was a member of the High Council of Justice and was considered close to Andrei Portnov.
Let us remind you that on August 6, the High Council of Justice decided to dismiss the judge of the Cassation Administrative Court as part of the Supreme Court, Vsevolod Knyazev, accused of receiving a bribe in the amount of $2.7 million.
