Lawyers for the former president have asked the judge overseeing the porn star payout case to overturn the former president’s conviction and postpone his sentencing, scheduled for July 11.
The lawyers’ letter came just hours after the US Supreme Court issued its ruling on presidential immunity.
The former president’s lawyers cite a July 1 Supreme Court ruling that US presidents have “absolute immunity” from prosecution for “official acts.” They say that could delay the sentencing.
The verdict itself is scheduled for July 11. Earlier, jurors found Trump guilty of 34 counts.
The US Supreme Court previously ruled that former President Trump has immunity from prosecution for official acts he committed while in office, but does not have immunity for unofficial acts.
The court’s decision concerned the case of the storming of the Capitol by supporters of Donald Trump on January 6, 2021.
The US Supreme Court has left it up to lower courts to decide when Trump can be held accountable.
The Supreme Court’s 6-3 decision, issued on the final day of the court’s current term, all but guarantees that Trump will not be tried before the presidential election this fall on criminal charges related to his efforts to overturn the official results of the 2020 presidential election.
