In her lawsuit, the woman argued that the war started by the Russian Federation and the “apparent inaction” of Ukraine, which “allowed a military conflict” with Russia, led to a violation of her right to peace.
This is stated in the court decision.
She demanded from the Russian Federation 49 million 843 thousand 18 UAH in compensation for property and moral damage. Meanwhile, the woman wanted to receive one hryvnia of moral compensation from Ukraine. The court decided to satisfy her claim partially, collecting 500 thousand UAH from Russia in compensation for moral damage caused. At the same time, the court did not find evidence of the validity of the plaintiff’s claims against Ukraine.
The court considers that in connection with the armed aggression of the Russian Federation against Ukraine, the PERSON1 experienced mental suffering, stress and fully justified fears for her safety, lost a loved one, a brother who died defending the independence and territorial integrity of Ukraine, therefore the Russian Federation should be recovered from the state in favor of the PERSON1 to compensate for moral damage caused by armed aggression against Ukraine, funds in the amount of UAH 500,000. The court considers the specified amount of moral damage to be sufficient and fair, based on the circumstances of the case and the evidence provided by the plaintiff, the decision of the Slavuta City District Court in the Khmelnytsky region states.
This is not the first such decision. In early March, a man also from the Khmelnytsky region won a court ruling that ordered him to pay him UAH 200,000 in compensation from Russia for moral damage caused to him by the war. The plaintiff complained of poor sleep due to the air raid siren and deteriorating relationships with people.
