Verkhovna Rada Commissioner for Human Rights Dmitry Lubinets called on the parliament to adopt the updated mobilization bill in the first reading. He made this appeal on Telegram on the evening of Tuesday, February 6.
According to Lubinets, he had an urgent meeting with the Minister of Defense of Ukraine, Rustem Umerov. In the meeting they discussed the mobilization bill.
“As a result of the meeting, I decided that this bill should be approved by the parliament in the first reading. This is what I addressed to the representatives of the people. In the second reading, the comments from the Office of the Ombudsman can be resolved Again, I note the quick positive response from the Minister of Defense of Ukraine,” – he wrote. .
In the past, the Ombudsman noted that this document violates, in particular, the norms of the Constitution.
“Unfortunately, government bill No. 10449 in terms of mobilization again has a number of contradictory provisions,” he said.
The “normative incident,” according to him, is the issue of the procedure for traveling abroad for men aged 18 to 60 years old who are registered in the military or are not included in it in the prescribed manner.
In addition, he noted that the bill also states that the military order can impose temporary restrictions on a citizen’s right to leave the country. However, according to the requirements of Article 17 of the Constitution, the Armed Forces of Ukraine and other military formations cannot be used by anyone to restrict the rights and freedoms of citizens. These proposed changes are contrary to the Constitution, said Lubinets.
The bill also proposes to provide an obligation to register the electronic account of a conscript, a person liable for military service, or a reservist, and for non-compliance, the latter has legal liability as stipulated by the Law. Lubinets said that it does not comply with the provisions of the Constitution, the law on the protection of personal data and the legal positions of the Constitutional Court of Ukraine regarding the official interpretation of the right to personal and family life.
