The South African case alleges that Israel is violating its obligations under a post-Holocaust treaty that makes it a crime to attempt the total or partial destruction of a person.
South Africa has asked the International Court of Justice to order that Israel violate its obligations under the 1948 Genocide Convention in its crackdown on the Palestinian group Hamas in Gaza. Reuters reported this on Friday, December 29.
South Africa says Israel, since the start of the Hamas offensive on October 7, has failed to prevent genocide and public incitement in it. The country asked the court to take steps obliging Israel to stop its military campaign in the Gaza Strip.
In turn, the Israeli Ministry of Foreign Affairs responded to South Africa’s actions and said that South Africa’s claim had no factual or legal basis and was an abusive use of a particular court. The Guardian writes about this in connection with a message on the social network X by the representative of the Israeli Ministry of Foreign Affairs, Lior Hayat.
“Israel has made it clear that the people of the Gaza Strip are not the enemy and is making every effort to limit harm to non-involved people and allow humanitarian aid to reach the Gaza Strip,” he said.
Israeli Prime Minister Benjamin Netanyahu named three conditions that must be met to end the war against Palestinian Hamas militants in the Gaza Strip.
