The Appeals Chamber of the Supreme Anti-Constitutional Court overturned the decision to close the Rotterdam+ case.

The HACS appeal on Thursday, December 14, satisfied the prosecutor’s request to cancel the first instance decision of the Anti-Corruption Court to close this scandalous case. The panel of judges of the Appeals Chamber did not take into account the evidence of the fact that the maximum period allowed by law for the pre-trial investigation had expired. This was reported in the broadcast of the court hearing.
Lawyers for the defense stated that they had to admit that there was again a lack of legal certainty in the law enforcement system. Previously, the “Rotterdam+” case was closed twice by prosecutors of the Specialized Anti-Corruption Prosecutor’s Office, but then invariably opened by the head of the SAPO or other boards of the Supreme Court. Thus, the preparatory meeting on the case will continue at the first instance of the HACS.
Let us remind you that on October 9, the High Anti-Corruption Court closed the case of damage from the Rotterdam+ formula, and the reason for the closure was that the pre-trial investigation period had expired after the person was informed of the suspicion.
In general, the investigation into the Rotterdam+ case, in which electricity consumers illegally overpaid billions of hryvnias, has lasted more than six years – since March 2017.
