In this case, it is necessary to submit (send) an application to the notary at the place of opening of the inheritance within the time limit for accepting the inheritance. (under the conditions of martial law or state of emergency, an inheritance case is opened at the request of the applicant by any notary of Ukraine, regardless of the place where the inheritance was opened). The authenticity of the signature on such application must be duly certified.
If you do not plan to visit Ukraine for even longer, I recommend that you simultaneously certify a power of attorney for a representative to complete all the necessary documents in Ukraine related to obtaining a certificate of inheritance, explains Derevianko.
An application and a power of attorney abroad can be issued in two ways:
- Through consular offices and diplomatic missions of Ukraine (at the same time, do not forget to certify the signature on the application for registration of such a power of attorney on the territory of Ukraine);
- Through a notary abroad (additional legalization may be required, depending on the country). Translation of such documents can be done already on the territory of Ukraine.
