Supreme Court USA ordered on Tuesday the government of the President Joe Biden maintain Section 42 as a precautionary measure, a health rule that allows for the immediate expulsion of migrants at the border.
Thus, the Supreme Court, in a five-to-four decision, agreed to a request from 19 state attorneys to freeze the suspension of Section 42 while the future of the rule is decided in court.
The High Court will hear arguments from those states and the federal government in February.
border between Mexico D USA These days, it’s still full of migrants awaiting the Supreme Court’s decision, after that court had already issued a precautionary stay against the rule.which was scheduled for December 21st..
The Supreme Court now retains the measure indefinitely, at least until it hears arguments from the parties.
A group of prosecutors from 19 states, including Texas, were the ones who forced the Supreme Court to make the decision. They argued that the suspension would cause “tremendous and irreparable harm” in immigration matters.
Measured since pandemic
In March 2020, the Government of the Republican Donald Trump (2017-2021) activated this medical tool for the immediate removal of migrants without a residence permit detained at land borders.
The rules have accelerated the expulsion of more than 2.7 million people since they went into effect, according to data. International Rescue Committee.
Rare exceptions are provided for some nationalities, such as Ukrainians since the invasion of their country Russiaor for unaccompanied minors.
Activists and human rights experts consider this measure a violation of international law. In particular, they consider it “inhumane” to prevent a potential asylum seeker from formulating their process in this regard.
In his opinion, the current system only encourages migrants to cross the border illegally and put themselves at greater risk by crossing deserts, hostile areas or rivers in which one can drown.
