Malyuska said when war criminals of the Russian Federation will be punished

The Ministry of Justice believes that punishment will not be as fast for war criminals as the Ukrainians would like.

War criminals of the Russian Federation will receive their first sentences for at least a year and a half or two. This was announced on Friday, April 29, by the Minister of Justice of Ukraine Denys Malyuska on the air of the information marathon.

“There are many bodies, or courts, that will eventually pass sentences on war criminals, among them military personnel and the highest leadership of the Russian Federation. These are national courts and prosecutor’s offices. , this is the International Criminal Court, which has jurisdiction over war crimes and genocide in Ukraine.It is a tribunal to be established for crimes of aggression, its creation was recently supported by the Council of Europe, as well as other courts states.The full launch of these mechanisms and the first sentences will take at least a year and a half or two.Because often international jurisdictions are very slow, and they are very fast terms, as a rule – it’s 6-8 years and more, ”the minister said.

According to him, the main problem is the physical confinement of the perpetrators.

“If the Ukrainian court passes the verdict, Interpol will be the tool for finding such people,” Maliuska said.

He added that when the verdicts are passed by the International Criminal Court, then, for example, Vladimir Putin could be imprisoned by a country recognizing the jurisdiction of the International Criminal Court.

“At a minimum, we will limit their ability to leave the territory of the Russian Federation, and then sooner or later we will get them physically. If I were the Russians, I would not leave the territory of Russia, although it does not guarantee security,” said the minister.

Accordingly, he said, the Ministry of Justice is developing a mechanism to punish the criminal money regime.

“Another punishment is to take away their money, to rebuild our economy for this money and pay money to our citizens. It’s a big block: European court of human rights, arbitration, a separate commission that we will do under a new international agreement that will provide access to the territory of the Russian Federation.But the situation is similar in criminal courts, in criminal courts you have to catch, in civil – you have to find Russian money .And most of this money is protected, unfortunately, by the sovereign immunity of the Russian Federation, because it is state funds.But we see how to remove this immunity and gain access to hundreds of billions of dollars, euros, pounds blocked abroad, ”Malyuska said.

He added that it was not months in question, but about a year or two and more.

“But the path is clear, the result will be achieved,” summed up the head of the Ministry of Justice.

It will be recalled that the previous Prosecutor General Irina Venediktova stated that in order to hold Russia accountable for war crimes against Ukraine, it is necessary to create a special tribunal. He said the investigation has already begun.
