Can the rejection of a first-instance asylum application be synonymous with automatic deportation for an alien? Home Secretary Gérald Darmanin, who is due to present the Asylum and Immigration Bill in January 2023, following debates on the subjects in Parliament next November, would like to see this legal mechanism set in stone. “We have proposed to the Council of State (…) that when there is a rejection of an asylum application, an OQTF (obligation to leave the territory of France) should be given at the same time, or in any case, a refusal of a residence permit and an emphatic deportation.”he announced.
