The Constitutional Court has issued a verdict on the demolition of the “Wall of Shame” separating La Molina and Villa Maria del Triunfo.

Plenary session of the Constitutional CourtCT) published a verdict this Friday in which he ordered the complete demolition of the wall separating the areas of Villa Maria del Triunfo and La Molina. Thus, he declares founded the habeas corpus petition filed by Carlos Francisco Ginostrosa Rodríguez against the then mayor of La Molina, Juan Carlos Zurek.

According to the decision, this demolition must be carried out within 180 calendar days from the date of publication of this decision. Inostrosa Rodriguez filed a lawsuit “for violating his right to free passage”, among other things, prior to the construction of the 4.5-kilometer border wall.

constitutional Court (CT) called executive branch to order the necessary measures for the full implementation and launch of the La Molina Ecological Park.

Likewise, he called Congress enact laws aimed at comprehensively combating the usurpation and illegal circulation of land, as well as other municipalities to prevent the construction or maintenance of walls that violate the rights of free movement, equality before the law and non-discrimination.

The decision was unanimously approved by Justices of the Peace Francisco Morales Saravia (President), Luz Pacheco Zerga, Gustavo Gutiérrez Tise, Hélder Domínguez Aro, Manuel Monteagudo Valdes and Cesar Ochoa Cardic.

La Molina against the verdict

The mayor of La Molina, Diego Useda, will assess the possibility of applying to international instances to avoid the execution of the sentence of the Constitutional Court, which orders the destruction of the wall separating his area from Villa Maria del Triunfo, called the “Wall of Shame”.

“Sentence on CT You cannot appeal, but you can go to international instances, but there is also an extension request strategy and legal strategies,” he said in press statements.

Diego Useda rejected the name “Wall of Shame” and explained that the structure is a stone wall on the border of the Ecological Park of La Molina and Villa Maria del Triunfo.

“We are protecting an ecological park bordering Villa Maria del Triunfo, with more than 200 hectares, which will be the green lung that Lima needs. We have been working on this since the administration of Mayor Paz de la Barra, who opened another 20 hectares, and we plan to build another 50 hectares,” he said.

The mayor pointed out that now is not the time to divide the Peruvians and call the inhabitants of Villa Maria del Triunfo “invaders”.

“They move freely. There is a stone wall that delimits the territory, and there are steps that people and friends from Villa Maria del Triunfo come to work in La Molina, and there is no problem with that,” he added.
