Former anti-corruption prosecutor Luis Vargas Valdivia, lawyer for the National Confederation of Private Business Institutions (trust), characterized this Thursday as “absurd” by the National Attorney’s Office against Ricardo Bricegno, a former union president, as the alleged perpetrator of the crime of money laundering and as the alleged perpetrator of the crime of fraud in the administration of a legal entity in the tort of the aforementioned institution in the cocktail case.
IN News Extension, Louis Vargas Valdivia explained the case Ricardo Brisenothe day before Lima’s Second Constitutional Chamber voted in favor of habeas corpus submitted by Ricardo Briceño following an accusation brought by prosecutor José Domingo Pérez.
“The prosecutor’s office of Dr. Domingo Pérez sent copies so that a legal entity fraud case could be initiated, a complaint that was completely dismissed by the prosecutor’s office (…) in this case, we don’t understand how the prosecutor’s office insists that Mr. Briceno bears responsibility for actions that are in no way crimes, let alone trust. We are also concerned that the pre-trial judge upheld the charge pending oral trial, when in this case it is impossible to get a conviction for the crime of money laundering, since it is necessary to prove that they received the assets from the crime, and in this case there is no crime. When managing legal entities, fraud crimes were not committed,” he said.
For this reason, Luis Vargas Valdivia hopes that tomorrow, Friday, the judiciary will recognize habeas corpus against the decision of the judge and order that Ricardo Briseno be removed from the process. “The prosecutor’s office does not have any elements to keep him in the process,” he insisted.
How did the case come about?
Luis Vargas Valdivia recalled that in 2010, 2011 and 2012. trust called for a campaign to disseminate various commercials in the media to educate the population about the importance of private investment for the economy and development of the country.
“In 2011, there was an event organized by Mr. (Ricardo) Briceno be accountable for their activities. At this event, the participants agreed to promote this campaign for a series of donations from private companies, among which was Odebrecht, represented by (Jorge) Barat. These contributions came through the financial system and were used to publish these videos,” he said.
He elaborated that the National Prosecutor’s Office first claimed that Jorge Barata indicated that in this case, contributions were requested to support Keiko Fujimori’s presidential candidacy.
“In progress trust conducted an audit that accurately takes into account the origin of funds, their income and purpose. In addition, the services of two companies were hired, which were responsible for checking the publication of these videos. What else has been done? statements from all the businessmen present at the event, who all agree that the purpose of these donations were those commercials, and there was never any talk of giving preference to Ms. Fujimori,” he explained.
However, Luis Vargas Valdiviaclarified that later, at the end of the trial, the prosecutor’s office changed the charge against Ricardo Briseno and claimed that trust was not authorized to receive contributions from companies in their statutes, and that in that sense, having received the money, the crime of fraud in the management of legal persons was committed to the detriment of trust.
“And that this money was finally used in a campaign that benefited Mrs. Keiko Fujimori. Therefore, this accusation is absurd, why? Because trust during the process, he repeatedly pointed out that the purpose of this campaign was to raise awareness about private investment, and not in favor of Ms. Fujimori or any other political party,” he said.
