Criminal Lawyer Louis Lamas Puccio explained that national prosecutorPatricia Benavidez, obliged to cooperate with the preliminary investigation against her by order of the National Council of Justice in connection with alleged irregularities in the formation Special White Collar Team.
“All officials, without exception, without exception, within the limits specified in the regulations, are obliged to cooperate with any kind of inquiry or investigation in terms of clarifying the facts regarding their functional behavior, in the event of any information of a different nature, suggesting the need for an investigation. to see if it corresponds that will be investigated in terms of functional responsibility,” he explained.
In an interview with RPP News, the lawyer considered that the justice of the peace had the right to criticize and call the decision of the National Council of Justice illegal and arbitrary. As you know, the head of the public ministry mentioned that this decision will be a response to the attacks that, according to her, she was subjected to for “investigating political power.”
“I think this is a difficult time for the National Attorney, as it has been in recent months, because of the decisions she has had to make. It should not be very pleasant that they start an investigation, although there are no facts because it is also amenable to political control by the opposition, those sectors that are interested in destabilizing the work that it is doing,” he said.
“A difficult situation, to some extent explainable, but I think that throughout the investigation it will be necessary to find out whether there were actually reasons. The question, in my opinion, is that it lends itself to manipulation of political content. (…) On the one hand, I recognize her state of mind, understandable to any person, without prejudice to the fact that she is the Prosecutor of the Nation, she is not just some kind of official, ”he added.
The National Council of Justice launched an investigation against the national prosecutor.
The Nation’s Attorney called the investigation illegal
Previously national prosecutorPatricia Benavidez, criticized the decision of the National Council of Justice (JNJ) after it moved to open a preliminary investigation against him in connection with alleged violations in the appearance of members Special White Collar Team. At the same time, he called this action illegal and arbitrary, since, from his point of view, the team was strengthened.
“I have just learned that by an illegal and arbitrary act, The National Council of Justice has ordered a preliminary investigation against me for alleged misconduct.like the fact that changes in the composition of the White Collar Special Group will be associated with the alleged presence of a telephone connection from me, ”he said in an address to the population.
“In this regard, I want to declare to all citizens that the decision of the National Council of Justice is void, because, as I have repeatedly said – and technical reports are available – the special white-collar group is not disbanded, but reinforced. So much so that in just six months, listening to all audio recordings was completed; what was not done in four years was done in six months,” he added.
Another time, the head of the Ministry of Industry and Trade mentioned that the decision National Council of Justice would have responded to the attacks he said he had received for “investigating political power.”
“This is the decision of the National Council of Justice represents the completion of the attacks launched since I made the decision to explore political power, which are risks assessed by the Inter-American Commission on Human Rights, which has provided me with a safeguard to ensure that I fulfill my role as the nation’s attorney. Opening a knowingly illegal investigation can only be an act of intimidation and obstruction of my prosecutorial function,” he concluded.
