The National Attorney’s Office has decided not to open or continue a preliminary investigation against FAP Colonel Ditter Allan Diaz Rogero and other members of the Air Force and the Ministry of Defense for the crime of incompatible negotiation and conspiracy. The case is related to the purchase of 20 KT1-P aircraft under an intergovernmental agreement in South Korea.
The document issued by the prosecutor’s office clarifies that the details of the preliminary investigation are confidential; therefore, they cannot make the content public in its entirety.
“In accordance with the provisions of Article 324 of the Code of Criminal Procedure, the investigation is closed, so only procedural subjects have access to its contents; Moreover, the facts that are the subject of the investigation correspond to the acquisition of basic flight training aircraft for the Peruvian Air Force, the documentation of which was classified,” the report says.
Origin of pre-production
As a reminder, after the approval of the final report of the Commission on National Defense, Internal Order, Alternative Development and Anti-Corruption of the Congress of the Republic on October 30, 2018, it was decided to initiate a preliminary case against Ditter Diaz, José Santa Cruz, Armando Paniccia, Josue Peralta, Uliana Mimbela, Ronnie Heredia, Jacque Raimo, Jorge Montoya, Oscar Santa Maria, Alfonso Artadi, Carlos Castro, Augusto Rosado and Paola Lobaton.
They were treated alleged crimes of incompatible negotiations and alternative collusion to the detriment of the Peruvian State “for the process of acquisition and joint production of 20 KT-1P aircraft under the intergovernmental regime (Peru-Korea)”.
