executive power promulgated this Friday, January 27, a rule approved by Congress that establishes prison sentences for those who appoint and accept public office without complying with legal requirements.
It’s about Law 31676which amends article 381 Criminal Code referring to “appointment, appointment, contracting, power of attorney, or wrongful acceptance of office.”
rulepublished in the official gazette Peruvian manestablishes that civil servant appointment of a person who is not responsible legal requirementsshall receive a prison sentence of not less than two and not more than four years. Same judgment rests with the one who takes public office without compliance.
“A public official who appoints, appoints, hires or authorizes a person who does not meet the legal requirements for public office shall be punished by imprisonment for a term of two to four years and 60 to 120 days. well. . Anyone who accepts this position without legal requirements will be punished with the same fines,” the text says.
Publication Law 31676 bears the signatures of the President of Congress, Jose Williams Zapata; First Vice President of the Parliament Martha Moyano; first minister, Alberto Otarola; and head of state Dina Boluarte.
The purpose of the ordinance is to “suppress conduct that affects the principles of merit, fitness and legitimacy of access to public service.”
