Judge grants temporary order allowing trans teen to join school team despite state law
The court order was issued in response to a lawsuit filed by the families challenging the Fairness in Women’s Sports Act, legislation recently signed into law by Republican Gov. Chris Sununu that bans transgender girls from participating in women’s sports teams at public schools and universities. While Iris Turmelle won’t start playing until later this year, Parker Tirrell will be able to join the team’s practices immediately.
The families argued that the law violates their children’s rights under the U.S. Constitution’s Equal Protection Clause and Title IX, which prohibits sex discrimination in educational institutions. The new law, they say, denies equal educational opportunities and discriminates against queer teens.
McCafferty stated that Parker demonstrated a significant chance of success on the merits of the case and questioned the effectiveness of the law in protecting cisgender girls from “unfair competition”, especially considering that Parker was taking puberty blockers to prevent physical changes.
The temporary ruling was met with relief by LGBTQIA+ advocates, including Chris Erchull of GLBTQ Legal Advocates & Defenders, who said: “We are very happy with the judge’s order. It’s what we’ve been waiting for because we know this law is unfair and violates the rights of transgender girls in New Hampshire.”
The court is expected to consider next week whether to permanently block the law.
