Burkina Faso bans homosexuality and increases repression against LGBT+

Measure is part of the new Individual and Family Code approved under the military regime

The government of Burkina Faso, under military rule since a coup in 2022, announced on Thursday, 11, the prohibition of homosexuality, classifying it as an illegal behavior. The Minister of Justice, Edasso Rodrigue Bayala, stressed that “homosexuality and related practices are now prohibited and punishable by law”, as reported by the Agence France-Presse.

The new text was approved by the Council of Ministers and is included within the scope of the new Individual and Family Code, but still requires approval by the Transitional Legislative Assembly (ALT) to come into force. Until now, there was no specific legislation that penalized homosexuality in the country.

This decision follows a growing trend of repression of LGBTQIA+ rights in the region. In August 2023, the Superior Council of Social Communication had already banned the broadcasting of television channels that promote homosexuality, reflecting the government’s conservative stance.

With this new legislation, Burkina Faso joins other African countries that have criminalized homosexuality, raising concerns about human rights and freedom of expression in the country. The implementation of specific penalties has not yet been defined, but the measure is seen as a significant step in cracking down on practices deemed “unacceptable” by the current regime.
