STJ has informative material to break down prejudices and guarantee the rights of trans people deprived of liberty
The highly informative material is illustrated with photos taken by STJ minister Sebastião Reis Júnior during a visit to the Pinheiros II Provisional Detention Center, in São Paulo (SP).
The starting point for shedding light on this issue, according to the STJ, is the decision by Minister Rogerio Schietti Cruz, who, in 2019, granted a transvestite in a semi-open regime the right to spend the night in the women’s wing of the Cruz Alta State Prison (RS). Before the decision, the transvestite was housed in the men’s wing – there was no wing or cell specifically for the LGBT+ population at the facility.
In the decision, Schietti recalled that, according to the Yogyakarta Principles, sexual orientation and gender identity are fundamental to the dignity and humanity of each person and should not be a reason for discrimination or abuse.
For the judge, the context of the case indicated that the transvestite was in an environment that was absolutely inappropriate for someone who identified as a female transsexual, making it necessary to place her in a place that would preserve her complete integrity, under the terms provided for in article 5, items XLVII and XLIX, of the Constitution.
