A group of business associations has announced its withdrawal from National Labor Council and Employment Promotion (CNTPE), in disagreement with recent labor changes set by the Department of Labor (MTPE).
Recently, the MTPE issued Supreme Decree 014-2022-TP amending the provisions of the Collective Labor Relations Law.
This decree establishes changes that will provide more opportunities for the formation unions and the development of strikes, which had not previously been agreed with the unions.
With this in mind, the National Confederation of Private Business Organizations (Confiep), the Association of Exporters (ADEX), ComexPerú, the Lima Chamber of Commerce, the Peruvian Chamber of Construction (Capeco), the National Society of Mining, Petroleum and Energy (SNMPE), the National Society of Industry (SNI), The National Society of Fisheries and the Association of Banks of Peru (Asbanc) sent a letter to the head of MTPE, John Lyraannouncing the suspension of his participation in the Work Council.
In a letter to the MTPE, the unions expressed their concern that practices continue to violate the institutionalization of the tripartite body of social and labor dialogue, “of which they cannot be a part”
“Members of the employers sector who signed the letter declare that until Supreme Decree No. 001-2022-TP and No. 014-2022-TP are rescinded, the request made by the ILO in a letter addressed to MTPE in April related to fulfillment of international obligations ratified peruvian governmentwe are suspending our participation in front of the CNTPE,” they said in a letter to Minister Lira.
These unions also warn that the MTPE is not fulfilling its obligation not to make unilateral changes related to the issues included in the preliminary draft of the Labor Code.
“Consensus has not yet been reached to define the process and methodology by which the regulation proposal will be presented to the social and labor dialogue within the TsNTPE”, they added.
Finally, business associations pointed out that this measure further weakens the institutional framework of the CNTPE and will have negative effects in terms of job creation, contributing to the growth of informal employment.
