Ukraine’s Naftogaz has initiated pre -arbitration proceedings against Gazprom for failing to comply with the “pump or pay” condition under the gas transit contract. This was announced by the head of the NAC Yuriy Vitrenko in the agency Interfax-Ukraine on Friday, May 27.

“We have already started the re -arbitration procedure. We are preparing appropriate appeals to Gazprom together with the lawyers. There is some time when we should try to resolve the issue before arbitration, if we do not resolve it, a new arbitration. The reason is that they pay less than they should pay under the contract. There is no justification for this – “download or pay” is our contract, he explained.
Vitrenko recalled that Gazprom’s failure to fulfill its obligations necessitated a breach of the settlement agreement, according to which Naftogaz withdrew claims in the $ 12.2 billion arbitration begun in 2018.
“If they do not fulfill the obligation to” pump or pay “, it means that they are violating not only the contract for transit arrangement, but also the arrangement agreement. That is, it is not only arbitration for the amount of the underpayment, but also for the $ 12.2 billion, which we removed from arbitration, ”the NAC head said.
